The Commission marked the first birthday of the EU Charter of Fundamental Rights this week with publication of its first annual report on its application. While public interest in the Charter runs high, its powers and remit are widely misunderstood. It is not a fundamental rights supercop, as Commissioner Reding put it. But it does cover a number of areas for which the EU is responsible, such as data protection, discrimination and border controls. The Commission promises to use the report as a guide in its policy and law-making. It should also help people know their rights better and help them determine where they need to turn when they think their fundamental rights have been violated by an EU institution or a national authority. This will happen when the political discourse shifts to the Medicare and Defense items in the budget and recognizes that the only way to avoid flushing retirees down the toilet or jettisoning America's role as global supercop is to put the American economy back on a diversified growth track. Once it becomes apparent that it does not matter who wins the election, the glass will switch from half empty to half full, and the markets will benefit."
